About This Policy

Employment Tax Servicing Corporation (“Emptech”) offers a range of employment-related products and services, including employment history and income verification, tax services, and unemployment claims management (collectively our “Programs”), to employers, lenders, property managers, social services providers, and other companies (“Employers” or “Verifiers”) and their employees, personnel, or applicants (“you”).

This Privacy Policy describes how Emptech treats the Personal Information we collect or receive from Employers about you. This Policy also contains information about the rights you may have over your Personal Information.

Privacy rights

Employers and Verifiers are contractually obligated to comply withall applicable legal and regulatory requirements when they use Emptech’s Programs and provide us with your Personal Information. We process your Personal Information on behalf of and at the direction of Verifiers. Please contact your Employer or Verifier if you have questions about why your Personal Information was provided to us, to opt out, or to exercise any rights you may have over your Personal Information.

If you maintain an account with us and continue using Emptech’s Programs beyond your relationship with your Employer or Verifier, you agree to the terms of this Privacy Policy by continuing to use our Programs. If you do not agree, please see information about your rights below or refrain from using our Programs or interacting with us.

Information Collection, Use, and Disclosure

We collect and receive information that identifies, describes, or is reasonably capable of being associated with you (“Personal Information”). Personal Information does not include information that is publicly available in government records or any data that has been deidentified, aggregated, or otherwise anonymized.

Information provided to Emptech is only used for the purpose for which Emptech has been contracted by your Employer or Verifier. Emptech does not and will not sell your Personal Information to third parties without first providing you appropriate notice.

The way Emptech treats your Personal Information depends on which Programs are used by you, your Employer, or your Verifier. Please refer to each Program below for information on how we collect, use and disclose Personal Information.

Verifyfast—Employment and Income Verification

When you, your Employer, or a Verifier use our Verifyfast employment and income verification Program, Emptech collects the following categories of Personal Information from you, your current and former Employers, payroll companies.

a

Personal identifiers, including your full name, email address, phone number, date of birth, and social security number.

b

Professional or employment-related information, including the name of your employer, your job title, hire date, and salary history.

c

Account information, including your username, password, and security questions.

d

Internet or network activity, including your internet protocol (IP) address, browser information, and interaction with our website (see our Cookie Policy below for more information).

We use this information to compile a report about your employment or income history and provide the services requested.

We do not disclose this information to third parties unless those parties have a legal basis or permissible purpose to obtain your Personal Information. For example if you authorized the Verifier or your Employer to receive information about your income history, then we will provide your information to the requesting party.

I-9 Verification

When Employers use our I-9 Verification Program they provide us the following categories of Personal Information:

Personal identifiers, including your full name, address, date of birth, and social security number.

b

Characteristics of a protected classification, such as your citizenship status or country of nationality.

c

Professional or employment-related information, including the name of your employer.

We use this information to process your I-9 Form and verify that the information on that Form is complete and accurate.

We disclose this information to government authorities and public agencies who process the I-9 Form, verify your identity, and your eligibility to legally work in the United States.

Employment Tax Services

When Employers use Emptech’s Employment Tax Management Program they occasionally provide us the following categories of Personal Information:

a

Personal identifiers could include full name, home address, and Social Security Number (SSN).

b

Professional or employment-related information, including the name of your employer.

We use this information to assist Employers in paying mandated taxes.

Wedisclose this information to various government authorities or public agencies who process and collect taxes from Employers.

Unemployment Claims Management

When Employers use our Unemployment Claims Management Program, Emptech acts as a third-party administrator to manage any claims for unemployment on the Employer’s behalf. To do so, we collect the following information from Employers and state agencies:

a

Personal identifiers, including your full name, address, date of birth, and social security number.

b

Professional or employment-related information, including the name of your employer, your job title, hire date, salary history, and the basis for your unemployment claim.

We use this information to manage, process, and administer payments for unemployment claims.

We disclose this information to various government authorities or public agencies who process unemployment claims.

Hiring Credits—WOTC

When Employers use our Work Opportunity Tax Credits (WOTC) Program we collect the following categories of Personal Information:

a

Personal identifiers, including your full name, address, age, date of birth, and social security number.

b

Professional or employment-related information, including the name of your employer and your start date.

c

Other information about the basis of your eligibility, like your veteran status or other benefits or assistance you may receive.

We use this information to determine if the Employer is eligible to receive a tax credit from your Employerand to process WOTCs on behalf of Employers.

We disclose this information to various government authorities or public agencies who verify your identity and eligibility, and process and collect taxes from Employers.

Talent Management and Onboarding

When Employers use our Talent Management and Onboarding Program we collect the following categories of Personal Information on behalf of your Employer:

Talent Management
a

Personal identifiers, including your full name and contact information.

b

Characteristics of a protected classification, such as your age or gender.

c

Professional or employment-related information, like your employment history or professional certifications.

d

Education information such as where you went to school or any degrees or you obtained.

Onboarding
a

Personal identifiers, including your full name, contact information, social security number, and other government-issued identifiers.

b

Characteristics of a protected classification, such as your age, gender, or nationality.

c

Professional or employment-related information, including your employment history, job title, start date, or salary history.

d

Education information, such as where you went to school or any degrees you obtained.

e

Information about any benefits you may receive as well as your beneficiaries or emergency contacts.

We host this information on behalf of Employers so they can manage their recruiting, hiring, and onboarding processes.

We do not disclose this information to third parties.

Other Disclosures

Nothing in this Policy restricts Emptech’s ability to collect, process, or disclose Personal Information to:

a

Comply with applicable laws or regulations.

b

Comply with a civil, criminal or regulatory inquiry, investigation, subpoena, or other lawful court order.

c

Investigate and prevent fraud or abuse.

d

Cooperate with law enforcement, government authorities, or regulatory agencies concerning conduct we reasonably and in good faith believe may violate the law.

e

Exercise and/or defend legal actions or claims.

Emptech may share your information with a successor to all or part of our business, as permitted by law. In the event or a merger, acquisition, reorganization, or similar transaction, or in the event of insolvency or bankruptcy, we may sell, transfer, or otherwise share some or all of our assets, including your personal information.

Verifiers and Other Third Party Collectors of Information

To provide our Programs and fulfill our contractual obligations to Employers and Verifiers, we may release your Personal Information to third parties as described above. This Policy does not govern how those third parties may treat your Personal Information, and we cannot make representations or warranties as to how those third parties may use your information. Instead, you should look to those parties’ privacy policies to understand how they may collect, use, or disclose your information, and to exercise any rights you may have.

Security

Emptech uses commercially reasonable physical, technical, and procedural safeguards to protect the confidentiality and security of your information.

We implement a combination of administrative, technical, and physical controls to protect our systems and your PII

We implement technology and process oriented data security measures to prevent unauthorized access, and keep security patches and software up-to-date

Encryption routines surround sensitive personal information

Data transfer is processed only through encrypted channels (for example, when providing credit card information)

Emptech stores and processes personal information solely in the United States

Data is backed timely and securely up to mitigate the loss of data should an anomaly occur

While we use industry-standard practices to protect your information, we cannot guarantee that your information will be completelysecure.

You can helpprotect your information by using complex passwords, logging out of your browser when completing a session, deleting unneeded browser history, and using good anti-malware and anti-virus software on your devices.

Your Rights

Controlling Your Account

If you would like to correct, update, or amend the information in your account, you may login and update your profile or contact us with a brief description of your request.

Opt-Out Requests

Under certain circumstances, you may also request to opt-out of our Programs or that we deactivate or delete your account. To do so please contact us and provide a brief description of your request. Upon receiving such a request, we will freeze your account and forward your request to your Employer or Verifier for consideration. Please note that your current and/or previous Employer or Verifier has contracted with Emptech to provide Emptech Programs, and we must process Personal Information to provide those Programs. If you opt-out, this may impact your ability to obtain products, services, or employment from your Verifier or Employer as stated in your Verifier’s or Employer’s policies, notices, or other disclosures.

California Privacy Rights

California residents may have additional rights over their Personal Information.

Request for More Information

You may have the right to request more information about how we treated your Personal Information in the past 12 months, including:

a

The categories of Personal Information we collected about you;

b

The categories of sources from which we collected that information;

c

Our business or commercial purpose for collecting that information;

d

The categories of third parties with whom we shared that information; and/or

e

The specific pieces of Personal Information we collected about you.

Request to Access Information

You also may have the right to request access to your Personal Information.

Request for Deletion

Under certain conditions, you may have the right to request that we delete your Personal Information. Logging out or uninstalling an app does not delete your account or the Personal Information we may have collected.

Third-Party Marketing or Selling

We do not provide your information to third parties for their direct marketing purposes, and we do not intend to sell your Personal Information to third parties without providing you notice and an opportunity to opt-out.

How To Exercise Your Rights

Verification

Before we can respond to your request, we must verify your identity using Personal Information. If we are not able to verify your request, we will contact you for more information. If we are unable to verify your identify after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.

Designating an Authorized Agent

You may designate someone to submit requests and act on your behalf (an “Authorized Agent”). To do so, you must provide us with written permission to allow your Authorized Agent to act on your behalf.

No Discrimination

We will not unlawfully discriminate against you for exercising any of these rights.

Information Regarding Children

Emptech’s Programs are not intended to be used by minors or children, nor do we intentionally gather Personal Information about users who we actually know are under the age of 13. If Emptech becomes aware of Personal Information collected from individuals under the age of 13, Emptech will use reasonable efforts to delete thePersonal Information associated with that individual.

Changes to this Policy

Emptech reserves the right to amend the terms of this Privacy Policy. If Emptech makes any material changes to this Policy or decides to use Personal Information in a manner that is materially different from the uses described in this Policy, we will use reasonable means necessary to notify you.
